Final Countdown To the EEA Deadline

As the time of EU Settlement Scheme Deadline is drawing near i.e. 30th June 2021 leading to a sudden increase in the number of applications for settlement. On 31st December 2020, the UK left the European Union by signing an agreement. The EU-UK Withdrawal Agreement has given a “Grace Period” since 1st January 2021 which means a deadline for UK Nationals including (EEA and SWISS Citizens) to apply for EU Settlement Scheme.

Those EEA nationals, who have completed a full period of residence in the UK i-e of 5 years, can celebrate because they will easily qualify for settlement status (permanent residence).

The Citizens who have not completed 5 years in the UK, can apply for pre-settled status which will get them a visa for the next 5 years. On completion of 5 years, they can apply for ILR (Indefinite Leave to Remain)

The Citizens who have completed 5 years in the UK can apply for Indefinite Leave to RemainThe requirement to avail of this opportunity is to provide evidence that can show that the applicant has not left the UK for consecutive 180 days in a period of 12 months during the 5-year tenure.

One can prove his residence for 5 years in the UK by providing the National Insurance record that was allotted to him when he got employment. In case, if these documents are not available then the applicant will have to submit a bundle of documents to prove his residency.

Where an applicant is EEA National:

For EEA nationals, the settlement status is too open for their children under the age of 21 and dependents too. Even if children and dependents have not completed 5 years in the UK, they are also eligible to apply for EU Settlement Scheme.

UK Employers:

They also were given a “Grace Period” to work till 30th June 2021 for being EU Citizens. The employer can accept the EU passport or Identity Card of EU Citizen Employees for availing the right to work.

What will happen if an applicant does not apply before 30th June 2021?

That is very clear, the person who does not apply for EU Settlement Scheme by 30th June 2021, will be considered an unlawful citizen in the UK. Many restrictions will be imposed on that person. Such a person will have to stay in the “Hostile Environment of the UK” till the date he obtains Settled or Pre-Settled Status.

It will be beneficial for applicants to apply as soon as possible within the given deadline to remain the Nationals of the UK.

30th June 2021 might not be the end for EU Citizens:

The news about the extension of the EU Settlement Scheme Deadline is circulating but Citizens should apply before 30th June 2021 to keep themselves on the safe side.

Home Office Remarks:

It has been confirmed by the caseworkers of the Home Office that the late applications will have discretion under some circumstances. It is possible to accept late application in case of serious excuse is given. This flexibility is just to make sure that the UK Government cares for its citizens.

Although, there is the possibility of an extension in deadline still an applicant must stay vigilant to generate his application for the EU Settlement Scheme.
